OA filed for quashing the sanction of terminal benefits like GPF, CGEIS, gratuity to other members, for declaration that the Applicant is solely entitled to receive the same and for direction to release the benefits to the Applicantdofp2024_00803Delayed payment of retiral benefits counts for simple interest at 12% per annum In this case, the Applicant was punished with reduction of pay for three years vide Order, dated 12-2-2015 before his date of retirement on 28-2-2015. Hence, his retiral benefits should have been granted atleast within three months after his retirement which led to the interest on delayed payment in this casedofp2024_00805Applicant sought for quashing of impugned Order, dated 28-1-2019 and direction to the Respondents to grant pensioner benefits and settle the pension casedofp2024_00806Applicant, a retired pensioner of Calcutta Telephones, was getting pension of ₹ 21,263 from United Bank of India which was reduced to ₹ 13,469 and a recovery of ₹ 2,59,550 was ordered without reporting any fault of the pensioner which reduction and recovery from the pension would disturb the pensioner of his monthly budget. Unexplained recovery, is unjust, iniquitous, harsh and arbitrary. Hence, such a recovery is impermissibledofp2024_00807Compulsory retirement of the Applicant which was set aside by the Mumbai Bench of the Tribunal is challenged in the High Court by Respondent is yet to be disposed of. Hence, the Tribunal after hearing both sides and analyzing the case held that the finalization of his pension and other retiral benefits has to wait till the Writ Petition No. 7568/2019 filed by Respondents earlier challenging the order of the Tribunal is disposed of. Hence, the payer in the OA seeking sanction of pension to the Apdofp2024_00808Respondents, Chief Secretary, Government of Punjab and others are directed to pay 7% interest on the amount of gratuity of ₹ 10 lakhs and part of leave encashment of ₹ 99,354 for delay beyond 3 months from these became due till the date of their actual payment to the Applicant. This order is to be complied within 3 months on receipt of this orderdofp2024_00809The incompetence of Respondents of BSNL in the delayed payment of gratuity and leave encashment resulted in payment of interest on those two itemsdofp2024_00810Applicant who is entitled for commutation of pension from the date of his retirement as per Rule 13 (3) of CCS (Commutation of Pension) Rules, 1981 without recovery of commutation of pension paid to the Applicant herein from 1-3-2013 to 14-12-2016 are not legally sustainable. Hence, the relief prayed for in the OA to disburse the Commuted Value of Pension (CVP) to him based on commutation factor of 8.194 as applicable on 1-3-2013 whereby the recovery from him the excess amount of pension paid todofp2024_00813Applicant, wife of a Chargeman-I in Defence Accounts, whose whereabouts are not known even after two years filed this application for payment of interest due to delayed payment of family pension at the rate applicable for GPF deposit. That request is accepted and interest is to be paid at applicable rate for GPF deposit after three months of receipt of letter, i.e. from 7-10-2009 till disbursement, i.e. 15-9-2015 within 3 months of the receipt of copy of this orderdofp2024_00815As the period of suspension in the present case who was compulsorily retired from service, i.e. suspension period from 3-4-2004 till he was compulsorily retired, is not indicated as to how that period is to be treated, the suspension period from 3-4-2004 till the date of compulsory retirement is to be treated as qualifying service for purpose of pension and pensionary benefits and to grant the Applicant all consequential benefits including arrear differential pension and pensionary benefits as pdofp2024_00816Applicant herein, a mentally retarded person, is entitled for family pension due to the death of his parents. Even though he is a major, due to his mental retardation, he is to be paid family pension through his maternal uncle, Shri Ved Prakash Kirpal who is looking after the interest of the Applicant. As the action of the Respondents, R-1, Secretary, Ministry of Personnel, Public Grievances and Pension, Department of Personnel and Training illegally denied family pension to the Applicant, R-1 idofp2024_00817Very belated recovery of excess payment from pension of a retired employee is not permissible which is the view taken in the case of 'State of Punjab and others v. Rafiq Masih in Civil Appeal No. 11527 of 2014, dated 18-12-2014'. Hence recovery from the pension of the Applicant on the ground of wrong fixation of pension done 27 years after his retirement is incorrect and the amount, if any recovered should be returned to the Applicant with interest on fixed deposits of Bankdofp2024_00820Applicant herein, a Chief Health Inspector (Grade II), requested for voluntary retirement due to his health condition which was accepted. On such retirement except in the case of normal retirement on superannuation, the retirement benefits have to be paid within six months from the date of relief. As the retirement benefits in this case was delayed from his date of retirement with effect from 1-10-2012 and DCRG was paid to him only on 15-12-2014, the Applicant was declared for entitlement of intdofp2024_00821Delayed payment of final settlement dues when the settlement dues are kept back due to a pending disciplinary case which was closed dropping the charge-sheet attracts interest on the delayed payment of settlement dues. The delayed payment attracts interest at the rate payable on GPF for delayed payment of retiral benefitsdofp2024_00822Delayed payment of pension and pensionary benefits results in payment of interest on the amount paid belatedly after six months from the date of retirement of the pensionerdofp2024_00824Interest on the delayed payment of pensionary benefits, even though admissible, in the present case, the Tribunal gave time to pay the interest within a specified time which was complied with by the department. But due to the inaction of the department in this case to drop the disciplinary proceedings pending against him on 12-10-2011, simple interest at 12% per annum on the amount received by the Applicant on 14-3-2012 from 10-11-2011 i.e., after expiry of four weeks from the date of expiry of dofp2024_00825All final settlement dues of a retired Government servant cannot be withheld if the charge-sheet is issued and served on him even the next day of his retirementdofp2024_00827An official in receipt of provisional pension is not entitled to any additional payment in the form of penal interest for delayed payment of pension or other retirement benefits like commutation, etc., in the absence of any specific rule or statutory provision that supports grant of penal interestG.I., M.F., O.M.
