Previously, I was posted in Field unit Dehradun under Directorate of Ordnance (C&S) Kolkata a department under Department of Defence Production New Delhi. In the year 2021, I purchased a flat in Dehradun and for purchase of the flat, Home loan amounting Rs. 37 Lakh was taken from SBI bank Dehradun. During my tenure in Field unit Dehradun, on 07th June 2023, I applied for HBA after submitting all my eligibility related documents. On 04/10/2023, HBA amounting to Rs. 17.68 lacs only was sanctioned to me by Directorate of Ordnance (C&S) Kolkata according to my eligibility. Disbursement of the above said HBA amount had to be done by Dehradun Field Unit where I was posted. However, the DFU vide its L No DFUDUN/PAY/HBA/2023-24 dt 23/02/2024 denied me the disbursement of HBA citing the reason that "HOD has to ensure that HBA sanctioned is limited to the amount of loan still due to be repaid by the Government servant. However, in your case the loan amount to be repaid is much higher than the amount of HBA and hence you are not eligible for HBA." In this regard, it is to be informed that out of total House loan granted by SBI, an amount of Rs. 34 lakh was due to be repaid by the undersigned, whereas HBA was sanctioned for Rs. 17.68 Lakh by the department. As per sub-clause

(ii) of Ministry of Housing and Urban Affairs OM no 17011/11(4)/2016-H-III dt 31/01/2018, "Head of Department should ensure that HBA sanctioned is limited to amount of loan still due to be repaid by government employee". And thus, as per my understanding, I am eligible for HBA of Rs. 17.68 Lakh and the interpretation of rule by the Dehradun Field Unit is erroneous and thus denial of the afore-said amount of HBA by Dehradun Field Unit is unwarranted. You are requested to kindly issue the clarification on the same.
