Applicant, wife of a Chargeman-I in Defence Accounts, whose whereabouts are not known even after two years filed this application for payment of interest due to delayed payment of family pension at the rate applicable for GPF deposit. That request is accepted and interest is to be paid at applicable rate for GPF deposit after three months of receipt of letter, i.e. from 7-10-2009 till disbursement, i.e. 15-9-2015 within 3 months of the receipt of copy of this order — This chunk pertains to an OA No. 1089 of 2014, where a wife of a retired Chargeman-I in Defence Accounts filed an application for payment of interest due to delayed family pension at GPF deposit rate... — Facts: Applicant is the wife of Late Ramakanta Routh who was retired Chargeman-I under the Respondents. He was reported missing since 18-6-2006. The Applicant informed the Police Authorities and also filed an O.A. No. 919 of 2012 which was disposed of directing the Respondents to dispose of the representation of the Applicant for family pension. Before filing the counter, the Tribunal learnt that the family pension has been sanctioned. Further, the Treasury Officer vide his Counter, dated 17-1-2017 gave the details of payment of family pension through SBI, Main Branch, Jaipur Town vide Memo No. 38, dated 5-1-2016. Other Respondents explained the delay in disbursement of pension. Applicant in her rejoinder states that the family pension was paid on 15-9-2015 after a delay of 9 years, 1 month. Respondents admitted that the Applicant submitted the application for family pension only on 7-10-2009. The claim of the Applicant is payment of interest for delay in the release of the pension to Applicant quoting an earlier case. Tribunal observed that quoted judgment in regard to interest is not applicable to the present case. Even though the Applicant requested for family pension, the same is delayed due to delayed submission of the requisite forms to the Applicant for filling up the same. Tribunal observed that the Respondents reasonably should have taken action so as to disburse the family pension within the time-frame when the application is reported to have been sent. As regards interest on delayed payment of gratuity, Rule 68 of CCS (Pension) Rules, 1972 should have been followed. The said Rule on interest on delayed payment of gratuity is reproduced. The rate of interest due to delayed payment is as per the decision of Government of India's Decision No. 2 which is reproduced. That rule states that interest for delayed payment of Retirement / Death Gratuity to be at the rate applicable to GPF deposits. Thus for delayed payment of family pension, interest at the rate of interest applicable for the GPF deposits will be payable to the Applicant.
