Rule 33 - Pension Resumption
Original Rule Text
33. Undrawn pension and arrears.– (1) Unless the Government by general or special orders direct otherwise, a pension remaining undrawn for more than a year, shall cease to be payable.
(2) If the pensioner afterwards appears or a claim is presented on his behalf, the payment of monthly pension accruing thereafter may be resumed, but the arrears shall be paid as per the procedure prescribed by the Controller General of Accounts.
(3) A gratuity payment order shall remain in force for one year only.
What This Means
Rule 33(2) of the Receipt and Payment Rules deals with a specific situation concerning pensioners. Imagine a pensioner stops receiving their monthly pension payments, perhaps due to being unreachable or presumed deceased. This rule explains what happens if that pensioner later reappears or someone makes a claim on their behalf. Basically, if the pensioner shows up again, their regular monthly pension payments will restart from that point forward.

Key Points
- 1Applies when a pensioner's payments have stopped and they later reappear or a claim is made on their behalf.
- 2Future monthly pension payments are resumed upon reappearance or a valid claim.
- 3Arrears (past unpaid pension) are paid according to the Controller General of Accounts' (CGA) prescribed procedure.
- 4Focuses on the resumption of pension and the handling of previously unpaid amounts.
Practical Example
Mr. Sharma, a retired government employee, stopped receiving his pension of ₹15,000 per month in January 2023. The pension department assumed he had passed away as they couldn't contact him. However, in July 2024, Mr. Sharma reappeared, explaining he had been traveling abroad. According to Rule 33(2), his monthly pension of ₹15,000 will resume from July 2024. The arrears from January 2023 to June 2024 (18 months x ₹15,000 = ₹270,000) will be processed and paid to him following the procedure laid down by the Controller General of Accounts.
