Para 8.6 - Procurement Agents | KartavyaDesk

Non-Consultancy Manual

Original Rule Text

8.6. Procurement Agents 1. Consultancy or Non-consultancy: a) Hiring of Procurement agents (PAs) can either be done as a Consultancy Service or Non-consultancy service, depending on the objectives and scope of assignment. b) Consultants: If the role of Procurement Agents primarily involves intellectual analysis, strategic planning, spend analysis, cost control, and advisory functions, it would be appropriate to hire them as Consultancy Services i.e. when they are asked to design/ implement new system or improve value for money or develop strategic procurement or carry out market building/ sourcing etc, where quality weightage of more than 30% is called for. c) Non-consultancy: On the other hand, if their responsibilities are only outsourcing of routine procedures without intellectual decision making, classifying them as outsourcing of Non-Consultancy Services would be suitable, i.e. when they only operate the existing procedures and crucial decisions are made by the client himself, where quality weightage can be 30% or less. In such a case please also refer to para 4.6.4 above.

What This Means

Para 8.6 of the Manual for Procurement of Non-Consultancy Services deals with hiring 'Procurement Agents' (PAs). It clarifies whether hiring a PA should be treated as a 'Consultancy Service' or a 'Non-Consultancy Service'. The key is to understand the nature of the PA's role. If the PA is primarily providing intellectual analysis, strategic planning, or advisory functions to improve procurement processes, it's likely a consultancy service. If they are simply outsourcing routine tasks without making critical decisions, it's likely a non-consultancy service. This distinction is important because it affects the procurement process and the weightage given to quality in the selection process.

The rule essentially provides a framework for determining the appropriate classification based on the scope of work. If the PA is expected to design new systems, improve value for money, develop strategic procurement plans, or conduct market building/sourcing activities, then it falls under consultancy. In these cases, quality is a major factor (more than 30% weightage). However, if the PA is only operating existing procedures and the client (government department) makes the crucial decisions, it's non-consultancy, and quality weightage can be 30% or less. This distinction impacts how the procurement process is conducted, including the selection criteria and evaluation methods.

Key Points

  • Procurement Agents (PAs) can be hired as either Consultancy or Non-Consultancy Services.
  • Consultancy Services are appropriate when the PA provides intellectual analysis, strategic planning, or advisory functions (quality weightage > 30%).
  • Non-Consultancy Services are suitable when the PA performs routine outsourcing tasks without critical decision-making (quality weightage <= 30%).
  • The classification impacts the procurement process, selection criteria, and evaluation methods.
  • Refer to para 4.6.4 for additional guidance when classifying PAs as Non-Consultancy Services.

Practical Example

The Ministry of Rural Development wants to improve its procurement process for agricultural equipment. They are considering hiring a Procurement Agent. In Scenario A, the Ministry wants the PA to analyze their current procurement practices, identify areas for improvement, develop a strategic procurement plan, and design a new system for supplier selection. This would be considered a Consultancy Service because it involves intellectual analysis and strategic planning. In Scenario B, the Ministry already has a well-defined procurement process. They simply need a PA to manage the day-to-day tasks of sending out RFQs, collecting bids, and preparing summaries for the Ministry's decision-makers. This would be considered a Non-Consultancy Service because the PA is only operating existing procedures, and the Ministry makes the crucial decisions. The quality weightage in Scenario A would be above 30%, while in Scenario B, it would be 30% or less.
