What This Means

Para 5.2.6 of the Manual for Procurement of Non-Consultancy Services deals with how bidders can change or withdraw their bids after they've submitted them. Think of it like this: you've sent in your application, but then you realize you need to update something. This rule tells you when and how you can do that. You're allowed to replace your original bid with a new one, or even withdraw it completely, but there's a deadline. This deadline is the official bid submission deadline. After that, you're stuck with what you've submitted.

This rule is important for both the government agency doing the procurement and the companies bidding for the contract. It ensures fairness and transparency. Bidders have the flexibility to correct mistakes or improve their offers before the deadline. However, it also prevents bidders from unfairly manipulating the process by changing their bids after everyone else has submitted theirs. If a bidder tries to withdraw or change their bid after the deadline, they risk losing their bid security (EMD) and facing other penalties. The procuring entity will then proceed with the evaluation of the tenders as per the guidelines mentioned in para 7.2.6-3.

In essence, this rule provides a clear framework for managing bid revisions and withdrawals, ensuring a level playing field for all participants and protecting the integrity of the procurement process.

Key Points

  • Bidders can substitute, alter, or modify their bids before the bid submission deadline.
  • Resubmitting a bid requires uploading all documents afresh, including the financial bid.
  • Only the last bid submitted before the deadline is considered valid.
  • Bidders can withdraw their bid before the deadline without penalty.
  • Withdrawal or modification after the deadline results in forfeiture of bid security/EMD and potential penalties.

Practical Example

ABC Solutions submits a bid of ₹50 Lakhs for a cleaning services contract to the Ministry of Urban Development. On the last day of submission, they realize they underestimated the cost of materials. They revise their bid to ₹55 Lakhs and upload the entire bid document again before the deadline. The system will only consider the ₹55 Lakhs bid.

Later, XYZ Enterprises submits a bid but then tries to withdraw it two days after the submission deadline because they received a better offer elsewhere. According to Para 5.2.6, XYZ Enterprises will forfeit their EMD of ₹2 Lakhs, and the Ministry can also take other punitive actions against them. The Ministry will then proceed with evaluating the remaining valid bids, including ABC Solutions' revised bid.
