An employee, in this case, serving in India Security Press, retired on health ground as accepted by the Authority, has to be given his due pension till he survived and family pension thereafter his death, if the charge-sheet is issued, in this case, charge-sheet issued for absence from duty, did not reach the final stage of grant of punishment for his absence — The given chunk pertains to an order allowing an OA (Original Application) filed by Smt. Mangala Dilip Malve, seeking pension and family pension after the death of her husband who served in the Curre... — Facts : Wife of late Dilip M. Malve has filed this OA for pension to that late husband and family pension to her after the death of her husband who served in the Currency and Coinage Division of Ministry of Finance at Nasik and retired from service on 17-10-1996. The husband who is a retired servant while alive wrote number of letters for the relief as above which was said to be under correspondence with the Under Secretary (CY), New Delhi. Applicant herein also wrote number of applications to R-2, General Manager, India Security Press, Nasik for which no satisfactory reply was sent except stating that the pension case is pending with the Ministry of Finance. R-2 also informed her that the case of absence of her late husband from 1-9-1988 to 16-10-1996 had been referred to Ministry of Finance which is yet to be settled. The Respondents submit that the period of absence unauthorizedly by her husband is more than 5 years and hence he was issued with a charge-sheet, dated 1-3-1993. After he was found fit for joining duty, he joined the service on 10-5-1995. The husband of the Applicant was retired from service on medical grounds vide ISP Office Order No. 307/C/Wages, dated 19-10-1996 and that the charge-sheet of her husband is pending with Competent Authority. At the time of hearing the case, the Respondent produced the letter which only said that the final settlement of her husband is pending with Ministry.
