Secretary, Mi... — Facts: The Applicant, Sub-Postmaster (Retd.) was subjected to disciplinary proceedings sometimes in 2008 and the Applicant superannuated in 2010, consequent to which the penalty proceedings continued under Rule 9(2)

(a) of the CCS (Pension) Rules, 1972. Her pensionary benefits were all withheld though years passed with any order for payment of terminal benefits. Hence, the Applicant has filed this OA praying for quashing of the Departmental Proceedings and to grant the Applicant regular pension with all consequential benefits. Respondents submitted that though the proceedings were concluded, the case is pending before the President of India.
