Applicant who joined as Sorting Assistant under Respondent Postal Department under R-1 to 5 filed this OA. In March 1999, he became completely bedridden due to Ankylosing Spondylitis and his disability was 100%. He prays for retaining him in service till retirement with full pay and salary with effect from March, 1999 and grant benefits of promotion. Without going into the merits of the case and accepting his prayer, Respondents are directed to make suitable arrangement by writing to appropriate Medical Authority / Board for examination of disability with a copy to the Applicant for the individual to present himself before the Medical Board. In March, 1999, he became completely bedridden due to Ankylosing Spondylitis and is continuing in the same condition. District Disability Board issued still certificate, dated 30-5-2007 certifying that the Applicant is suffering from the above-said disease and extent of disability now is 100%. During his service, he became disabled and as per Section 47 of Persons with Disability (Equal Opportunities, Protection of Equal Rights and Full Participation) Act, 1995, he is entitled for full pay and salary during the period of his disability. Section 47 also states that no establishment shall dispense with or reduce in rank an employee who acquires disability during his service and his promotion will not be denied. Under the circumstances, he sought for invalid pension. But the authorities (Respondents) did not grant invalid pension to the Applicant. Respondent Nos. 1 to 5 state that the Applicant is to produce a disability certificate from the Competent Authority to take a proper decision to which the learned Counsel for the Applicant has also agreed to.
