R-1 voluntarily resigned from part-time job which was accepted by Department on 28-8-2014 and discharged the R-1 forthwith. R-1 approached the Controlling-cum-Assistant Labour Commissioner seeking gratuity which was denied by the department. Department submitted that since R-1 voluntarily resigned from department, the said R-1 is not entitled for gratuity. On hearing both sides, the Apex Court held:
