In the selection for the post of GDS BPM, it is to be done on the basis of marks obtained in the Matriculation examination. Possessing some land property is only an additional qualification. The Applicant herein who stood below all applied for the above post is not selected which cannot be questioned — Case O.A. No. 790 of 2013 concerning non-selection for GDS BPM post at Bhitaha Nizamat Branch Post Office, based on applicant's performance in Matriculation examination, work history as daily wager o... — Facts: The Applicant who applied for the post of GD S BPM at Bhitaha Nizamat Branch Post Office was not called for interview. Hence earlier he filed O.A. No. 560/2011 after which he was issued a call letter. The Applicant challenged the appointment of Private Respondent at R-5 in the present OA. The Applicant also not stated that he has got the highest marks among all the candidates called for interview. The only ground on which he filed that OA was that, he worked as daily wager and as a substitute and hence he should have been called for the selection of GDS BPM. The O.A. No. 560 / 2011 was disposed of leaving it to the discretion of the Appointing Authority to follow rules and regulation of the Department in making such selection. This OA is filed for non-selection of the Applicant. The judgments in the OA relied upon by the Applicant states namely, Shambhu Dutt Pathak v. Union of India in CWJC No. 12513 of 2009 filed in High Court, it was said that minimum qualification required is VIII standard with preference to Matriculation and compulsory condition of alternate independent source of income is preferred. In the present case of GDS BPM, there is a specific provision for selection based on marks secured in Matriculation or equivalent examination. Selection is based on marks obtained in Matriculation. Operative part of the judgment in O.A. No. 560/2011 is reproduced wherein shortlisting of candidates is based on marks.
