Severance amount of GDS (Gramin Dak Sevak) on their appointment as Multi-Tasking Staff (MTS) is to be paid only at the rate that is applicable to them on the date of their notional appointments. But the excess amount paid to the petitioners herein by way of severance amount at enhanced rate should not be recovered — This chunk discusses a labor dispute between four applicants who were employed as Gramin Dak Sevak (GDS) but later promoted as Multi-Tasking Staff (MTS). The dispute revolves around the rate at which... — Facts: There are four Applicants in this OA, the Tribunal permitted them to join together to file this OA. The Applicant now working as Multi-Tasking Staff (MTS) joined in service as Gramin Dak Sevak (GDS) in compliance with the order in O.A. No. 560/2008 and connected cases. They were given retrospective appointment as MTS notionally from the date the vacancies arose which is prior to 2010. They were given severance amount at the rate applicable on the date of their actual posting as MTS as the delay in posting them as MTS from GDS was due to the fault of the Respondents state the Applicants. This OA is filed for a declaration that the Applicants are entitled for severance amount at the rate prevailing on the date of their discharge from GDS service. The Tribunal considered the averments of both sides. The issue to be resolved is, from which date, the Applicants have to be treated as served from the engagement as GDS for the purpose of taking up the present post and at what rate they are entitled to get severance amount payable. Till 9-10-2009, the severance amount on their discharge was a lumpsum of 30,000. This amount varies for service for 20 years, service between 15 and 20 years. But from 9-10-2009, the amount is revised at the rate of 1,500 for every completed years of employment subject to a maximum of 60,000. The minimum eligible period was reduced to 10 years. The Applicants contend that, they are eligible to get severance amount at the rate applicable from 9-10-2009 as they were promoted as MTS by Order, dated 22-7-2010 till then they were GDS employee. But the Respondents agreed that, they were posted as MTS notionally from an earlier date when MTS vacancies arose. They further admit that the benefits of New Pension Scheme facilitate them to count their qualifying service from the date the vacancies arose as MTS.
