Sahoo was selected and appointed to the post of GDS BPM, Lathiapada BO. The present Applicant Shri Narendra Kumar Guru challenged this appointment. Pursuant to the order of the Tribunal, dated 24-11-1999, the Chief Postmaster-General, Odisha Circle vide Memo, dated 22-8-2000 provisionally engaged Shri Narendra Kumar Guru as GDS BPM of Lathiapada BO with effect from 20-10-2000 in place of Shri Sahoo. Shri Sahoo then approached the Tribunal and the Tribunal vide its Order, dated 13-2-2002 quashed the Memo, dated 22-8-2000 cancelling his appointment to the post of GDS BPM, Lathiapada BO. As against this, a writ petition was filed before the Hon'ble Court of Odisha, which was also dismissed on 22-4-2009 upholding the order of this Tribunal, dated 13-2-2002. Finally Shri Sahoo was appointed as GDS BPM, Lathiapada BO cancelling the appointment of Shri Guru. The Applicant, Shri Guru again filed this OA seeking direction to provide alternate engagement in any vacant post of GDS BPM taking into consideration his past experience. The Hon'ble High Court of Odisha disposed of the W.P. on 16-7-2011 with a direction to engage Shri Guru in any vacant post. In compliance of this order, the Applicant was engaged as GDS BPM, Baulasahi BO which he joined on 1-12-2011. His TRCA was fixed at the minimum entry grade. Aggrieved, by this, he submitted a representation praying for grant of seniority and fixation of TRCA based on his initial date of engagement. It was rejected. He again appealed on 17-6-2014. As it was not considered, he filed O.A. No. 990 of 2015 which was disposed of on 20-5-2016 directing the CPMG, Odisha to dispose of the representation in accordance with rules. The CPMG, Odisha rejected the representation stating that the Applicant has accepted the condition that the engagement as GDS BPM, Baulasahi BO was with TRCA applicable to that post and that counting of past service and grant of higher TRCA was not in accordance with rules. The Applicant again prayed for fixation of TRCA and seniority taking into consideration his initial date of appointment with effect from 20-10-2000.
