The Tribunal assailed the long delay in fixing pensionary benefit to the Applicant who retired on 16-9-1982 in 4th, 5th and 6th CPC and directed the Respondent authority to adjudicate and decide the issue within a period of two months from the date of receipt of the order — The given chunk pertains to an OA (Original Application) No. 316 of 2012 filed by a retired employee of Shasastra Seema Bal (SSB), who has not received his revised pension in 4th, 5th, and 6th CPC si... — Facts : The Applicant who worked in the department of "Shasastra Seema Bal (SSB)" retired on 16-09-1982 in the scale of pay of ₹ 262-350. His revised pension in 4th, 5th and 6th CPC is not settled. Hence he filed this OA to grant him revised scale with effect from 1-1-1986 and successive recommendation in 5th and 6th CPC scales of pay and pay the revised pension and arrears with 18% of interest. On 24-2-2000, Assistant Director issued a letter to the Commandant, Group Centre, SSB, R-4 herein, on the fixation of revised pension to the Applicant as per instruction contained in the O.M and to work out the revised Consolidated Pension from 1-1-1996 and forward the Form-7 to the concerned authority. R-4 also issued a letter, dated 10-3-2000 to the Commandant, Group Centre, SSB Haflong, R-5 herein forwarding the application of the Applicant. It was informed in that letter that the concerned pension processing file is not available and hence R-4 is not in a position to process the pensions for Applicant. The Applicant is waiting for his pension fixation for 30 years. Lastly on 9-7-1912, he addressed a letter to Senior Asstt. Director of Accounts, Cabinet Secretariat for finalizing the pension of the Applicant. The Applicant requested for adjudication of his pension case pending before the department within a time frame.
