Delay in filling up the Group 'D' posts from the category of GDS employee, in the present case, the Applicant, a GDS employee, selected for the post of Group 'D' post, deprives them of their pensionary benefits if they are possessing qualifying service for pensionary benefits and adequate Group 'D' service for pensionary benefits after assuming as a Group 'D' employee — The given chunk is part of a case report where an employee, appointed as Group 'D' in 2004, filed an application to be promoted to a Group 'D' post that arose in 2002 due to delay in his appointment ... — Facts: The Applicant herein while functioning as Gramin Dak Sevak Mail Packer (GDSMP) was appointed as Group 'D' from 9-10-2004 based on seniority-cum-fitness against vacancies earmarked for 2002. The complaint of the Applicant is that, he will not be included in the pension scheme governed by CCS (Pension) Rules, 1972 due to delay in appointing him in 2004. Hence he filed this application praying for promotion to Group 'D' posts arising in the year 2002 with all consequential benefits such as grant of General Provident Fund and pension scheme as prevalent in the year, 2002 and to stop recoveries towards contribution under New Pension Scheme and refund the amount already recovered within a time-frame with costs for filing this OA. Number of replies and rejoinders were filed by both sides to sustain their case. The Tribunal considered the viewpoints of both sides. The contention of the Respondents that the GDS employees should wait for the Screening Committee decision for appointment to Group 'D' posts is rejected. The Applicant came for consideration for the Group 'D' posts in the third selection as in persons selected in first two selections did not accept the Group 'D' posts which delayed the selection and promotion of the Applicant.
