Applicant herein, a retired Assistant Postmaster (Treasury) (HSG I is entitled for revision of pension based on Pay Band plus Grade Pay applicable to HSG I w.e.f. 1-1-2006. Hence the PPO of the Applicant is to be revised specifying pension on the basis of 50% of the minimum pay in the Pay Band plus Grade Pay of ₹ 18,460 i.e. ₹ 9,230 with effect from 1-1-2006 and also corresponding family pension with all consequential benefits including arrears of pension within three months from the date of receipt of this orders — Retired Assistant Postmaster (Treasury) (HSG I) seeks revision of pension based on revised pay scale applicable to his position from 2006, but Respondents argue that it should be based on original pa... — Facts : Applicant retired as Assistant Postmaster (Treasury) (HSG I) from Kottayam on 31-10-2005. His pay scale at the time was ₹ 6,500-10,500. Due to introduction of 6th Pay Commission accepted pay scale, the revised pension of the Applicant comes under the revised pay scale of ₹ 9,300-34,800 plus Grade Pay of ₹ 4,600. Applicant accordingly prayed for revised pension as per 6th Pay Commission accepted Pay Band for which no reply was issued wherein. Hence he filed this OA for revision of his pension based on the Pay Band plus Grade Pay applicable to HSG I with effect from 1-1-2006 with all consequential benefits. Respondents states that the pension of the Applicant is fixed as per 6th CPC of ₹ 9,300-34,800 plus Grade Pay ₹ 4,200. Hence his pension fixed is in accordance with OM, dated 1-9-2008 issued by Ministry of Personnel. Postal Directorate vide their letter, dated 10-7-2013 clarified that the revision is to be made keeping in view the revised pay scale / Grade Pay corresponding to the pay scale from which the pensioner had retired and not the revised pay scale of the upgraded posts. Hence the Applicant is not eligible for revision of pension as per the upgraded scales. Tribunal considered the arguments of both sides. Tribunal noted the judgment in a similar O.A. No. 180/315/2017 disposed of by the Tribunal. Paras. 7, 8, 9, 10, 11,12, 13 and 14 of that judgment is reproduced.
