Applicant who was initially joined as Junior Engineer (Civil) under Department of Posts and Telegraph proceeded on deputation keeping his lien with his parent department and finally was absorbed in International Airports Authority of India with effect from 2-8-1978. His prayer for pro rata pension on retirement from Telecommunication Department was granted on 16-10-1987 at ₹ 96 per month as per 4th CPC instead of ₹ 375 p.m. with effect from 1-1-1986 as prayed by him. Then he joined International Airports Authority of India, New Delhi on 20-5-1977 keeping his lien in Postal Circle, Calcutta where he worked up to 1-8-1978. He was permanently absorbed in International Airport Authority of India with effect from 2-8-1978. Applicant was granted by Respondents authority by the Telecom Department retirement benefit for pro rata pension on 16-10-1987 of ₹ 98% per month. Applicant represented for grant of ₹ 375 p.m. with effect from 1-1-1986 to Respondents which yielded no result. Hence he filed this OA for pro rata pension of ₹ 375 p.m. with effect from 1-1-1986. Respondents submit that the Applicant is entitled for pro rata pension as per order of 4th Central Pay Commission as per Para. 10 of G.I., Department of Pension and Pensioners' Welfare O.M., dated 16-4-1987. He is entitled as per provision of Rule 6 (i)
(ii) of CCS (Commutation of Pension) Rules, 1981. Commutation of pension becomes absolute on the date when medical authority signs the medical Report in Part-III of Form-4. Medical examination of the pensioner had not been completed.
