Family pension to the Applicant herein, due to death of his father who was a regular Mazdoor in Department of Telecommunication at Dhubri while in service, is to be considered for grant of family pension as unmarried daughters above the age of 25 is eligible for grant of family pension as per recent directive of the Government and also the Applicant obtained share in the DCRG of her late father which is a proof of her dependency on the late employee — The given chunk is a part of an Order Application (O.A.) regarding family pension eligibility for an unmarried daughter, Minati Ghosh, who was over 25 years of age and had received a share in her lat... — Facts:The Applicant is the daughter of late Narendra Lal Ghosh who was a regular Mazdoor in the BSNL, Assam circle and died on 15-4-1995 while in service. Applicant's mother died on 4-9-1992 prior to the death of late Narendra Lal Ghosh. The Applicant states that her late father left behind him 11 siblings. Soma Ghosh, one of the siblings got married and hence the family pension granted to Soma Ghosh was stopped. DoP&T, OM, dated 6-9-2007 enables unmarried daughters above the age of 25 to get family pension. Hence, she is entitled for family pension even though she is over 25 years of age. Her application for grant of family pension was submitted to Controller of Communication Accounts (R-2), but was rejected by the Chief General Manager, Telecom Circle (R-3) on the ground that the name of the Applicant is not included in the family declaration form. In view of the above, she has filed this OA for setting aside the rejection letter, dated 10-12-2014 for grant of family pension to her which was wrongly issued only on the ground that her name does not appear in the family declaration even though she got a share in the DCRG of her late father. The written statement filed by the Respondents state that the family of late employee had 11siblings and the name of the Applicant is not found as per the family declaration of her deceased father, dated 29-4-1993. Respondents further state that the nomination form submitted by the late employee in his statement was attested by the Sub-Divisional Officer, Dhubri Division. That statement is authentic. However, the Respondents could not satisfactorily explain as to how and on what basis the Applicant was given DCRG benefits by Letter, dated 1-2-2000.
