The Tribunal found no illegality in punishing the delinquent employee, the Applicant herein, as the punishment is warranted and is not shockingly disproportionate to the gravity of charges — This chunk pertains to an OA (Original Application) No. 162 of 2013, challenging the removal from service of a GDS BPM (Grameen Dak Sewak Branch Post Master) due to misappropriation of public funds i... — Facts : The Applicant, who was a GDS BPM, Deorigaon BO, Nagaon District was charge-sheeted for misappropriation of money deposited by public. An inquiry was conducted. The Applicant failed to credit ₹ 82,233.40 received from depositors thereby violating the provisions of Rule 132 (f), 133 (2), 134 (1) and 234 (2) of the Rules for Branch Offices. Thus he failed to maintain absolute integrity and devotion to duty as enjoined in Rule 21 of the Department of Posts, Gramin Dak Sevak (Conduct and employment) Rules, 2001. The enquiry held him guilty of charges. He was punished by removal from service by punishment order, dated 18-11-2011 which is challenged in this OA.
