Government (Postal Department) is fully responsible to allow the selected Gramin Dak Sevak Branch Postmaster (GDS BPM) to join duty at the allotted station by resisting all impediments created by public / others. If not possible, post him at other place where vacancy exists. Failing both options he is entitled for his emoluments — The selected Gramin Dak Sevak Branch Postmaster (GDS BPM) was prevented from joining duty at the Chiponsila Branch Post Office due to public unrest, despite being selected following the rules. The in... — Facts: The Applicant herein was selected for the post of Gramin Dak Sevak Branch Postmaster (GDS BPM) for the Chiponsila Branch Post Office following the rules and verifying the accommodation, etc. Order was issued on 17-9-2010. He also deposited the security deposit of ₹ 25,000. He went along with Sub-Divisional Inspector (P) to the said P.O. to take over as GDS BPM. But the local people in connivance with the officiating BPM prevented him from joining the post. He represented to Superintendent of P.O. (R-3) herein to enable him to join the post but his request went in vain. The local newspaper also published this case under the caption "Candidate Fled Away By Public". The Applicant also approached the Superintendent of P.O., Goalpara Division to get all facilities to join duty by apprising him of the position. But no action was taken by the said Superintendent of P.O. He then made a representation to Director of Post Offices for assisting him to join the post. But his efforts went in vain. Hence he filed this OA for the relief of enabling him to join as GDSBPM in that post office or elsewhere. The Applicant relied on the case of A.A. Calton v. Director of School Education and another [ 1983 (3) SCC 33 ] to state that the process of selection is an integrated process and that in every stage certain rights are created in favour of one or other candidates. As he could not join the post and also the departmental authorities failed to assist him to join the post, he may be posted elsewhere where the vacancy exists. The Respondents submit that as he failed to join duty due to protest from public, his selection of GDSBPM of that post office had been cancelled and his candidature had been dismissed. He cannot be posted in other post office also as he was selected only for Chiponsila P.O. as the duties and responsibilities in each post office varies.
