He was working as Extra-Delivery Agent in Banda Division of Kanpur Region and hence his candidature for selection to the post of Postman was accepted against the selection post numbering 17. But he was not selected. Hence he appealed against his non-selection in CAT, which is numbered as O.A. No. 546 of 1992.

Respondents state that his qualifying mark in that selection of Kanpur Region is much below the last one selected to the post of Postman in that Region. Though he was not a party in the cases filed in lower courts namely, CAT and High Court, he filed this appeal in Apex Court contending that his mark in Kanpur Division is within the last person selected. Hence he cannot be left out from the list of persons selected for the post of Postman.

The Apex Court after hearing both sides held:
