Para 13.34 — MSO (A&E)
Original Rule Text
13.34 As the leave accounts of gazetted officers are maintained by the Accounts Officer, a certificate of admissibility of leave has to be obtained from the latter before the competent administrative authority accords sanction to the leave. 13.35 On receipt of the orders sanctioning leave (which should be checked with the certificate of admissibility of leave and also in due course with the formal notification in the gazette), and the charge report of making over charge, the leave salary
certificate should be issued in the same way as the pay slip. 13.36 In the case of L.P.R. or Terminal Leave or such other leave on the expiry of which the gazetted officer is not expected to return to duty, the last payment of leave salary should not be made until the Disbursing Officer has satisfied himself by reference to the Accounts Officer, the departmental authorities and his own records that no demands are outstanding against the Officer. The leave salary certificate in such cases should also contain instructions to the effect that the certificate from the gazetted Officer concerned that he has not been re-employed during the period of the leave under Government Local Fund or a private employer, should be obtained before making payments.
Note.- An officiating Gazetted Government Servant who holds an active or suspended lien on a nongazetted post, retains his Gazetted status for all purposes (eg. Drawal of leave salary and allowances, issue of notifications, grant of extension of leave etc.) before resuming duty as a nongazetted officer. The leave salary certificate in such cases is accordingly issued as for a Gazetted Officer in the usual manner.
What This Means
Leave accounts of gazetted officers are maintained by the Accounts Officer. Before any administrative authority can sanction leave, it must first obtain a certificate from the Accounts Officer confirming the leave is admissible. Once leave is sanctioned and the charge-making-over report is received, a leave salary certificate is issued like a pay slip. For terminal leave or leave preparatory to retirement, the last payment is withheld until all outstanding demands are cleared, and the officer must certify they have not been re-employed during leave.

Key Points
- 1Leave admissibility certificate from the Accounts Officer is mandatory before leave can be sanctioned
- 2Leave salary certificate is issued after receiving sanction orders and charge-making-over report
- 3For terminal leave or LPR, last payment is held until all outstanding demands are verified as cleared
- 4Officers on terminal leave must certify they were not re-employed during leave before receiving final payment
- 5An officiating gazetted officer retains gazetted status even after reverting to a non-gazetted post until resuming duty
Practical Example
A Director applies for 6 months of Leave Preparatory to Retirement. The department first writes to the AG office for a leave admissibility certificate. After receiving confirmation, the department sanctions the leave. Before the final leave salary payment, the AG verifies with all relevant offices that no government dues are outstanding against the Director.
