The applicant... — Facts: Late Khirendra Momin, an employee of Postal Department died on 12-1-2018 while in service. Applicant who legally married Late Momin submitted an Application to Respondent authorities for releasing the terminal benefits of her late husband like gratuity severance EDGIS, etc., and also for releasing the amount of two policies in the name of deceased Momin earlier his marriage with the Applicant, Late Momin married one Smt. Prishmina Sangma who had died on 15-1-2015 and the husband of late employee married the present Applicant. First wife had two sons who had attained majority and living with the Applicant herein. Applicant's marriage with Late Momin was issued with the Succession Certificate by the District Judge. But even after the death of Late Momin succession certificate was not issued in the name of the Applicant by Respondent. Hence the Applicant filed this OA to pay her the terminal benefits of her late husband such as Gratuity, Severance, EDGIS, etc., with interest. She also prayed for settlement amount of two Postal Insurance in the name of her late husband. Tribunal heard the pleas of both sides. Basically the Applicant is asking for terminal benefits of her late husband. The two sons of late Khirendra Momin born to his first wife had no objection in issuing the Succession Certificate to the Applicant. Accordingly, the District Judge of Goalpara had issued the succession Certificate to the Applicant.
