Applicant herein, Assistant Librarian on temporary basis in the National Institute of Public Co-operation and Child Development (NIPCCD) was appointed on regular basis prays for fixing her pay scale to ₹ 5,500-9,000 with effect from 1-1-1996 instead of keeping her pay scale as ₹ 4,500 - 7,000 in view of 52nd meeting of the Executive Council of NIPCCD, which recommended the pay scale ₹ 5,500 - 9,000 for the post of Library Information Assistant where Applicant in serving. Hence this OA is filed for not fixing her pay scale in scale of ₹ 5,500 - 9,000. The approval ... — Facts: Applicant was selected and appointed as Assistant Librarian on temporary basis in the National Institute of Public Co-operation and Child Development (NIPCCD) vide Order, dated 21/24-4-1995 pursuant to which the Applicant joined at Regional Centre of NIPCCD of Guwahati on 15-6-1995. Applicant states that she was appointed in the regular manner on receipt of her application to that post in the pay scale of ₹ 1,400 - 2,600 as per order, dated 24-7-1990. In 5th CPC, it was recommended to fix the pay scale of that post in the pay scale of ₹ 5,500 - 9,000 with effect from 1-1-1996 by merging the existing post of Library Information Assistant and Senior Library and Information Assistant having minimum qualification of B.Lib. along with a graduate degree to ₹ 5,500 - 9,000 with effect from 1-1-1996. That pay scale was accepted by Government of India vide OM., dated 21-2-2002. Grievance arose to the Applicant when she was wrongly placed in the lower pay scale instead of the scale of pay of ₹ 5,500 - 9,000 with effect from 1-1-1996. Hence she filed this OA for seeking her pay scale as ₹ 5,500 - 9,000 with effect from 1-1-1996. Tribunal heard both sides and perused the pleadings and material placed before the Tribunal. Tribunal noted the claim of the Applicant for granting the benefits of higher revised pay scale of ₹ 5,500 - 9,000 instead of ₹ 4,500 - 7,000 with effect from 1-1-1996 in view of the 52nd meeting of the Executive Council of NIPCCD held on 31-3-2003. The Committee examined the proposal and approved for revision of pay scale from ₹ 4,500 - 7,000 to ₹ 5,500 - 9,000 for the post of Library Information Assistant where the Applicant is serving. NIPCCD, New Delhi vide Office Order No. 222/03, dated 15-9-2003 stated that upon the approval of Executive Council in 52nd meeting held on 31-3-2003 for the post of Technical Assistant / Assistant Librarian where the existing pay scale of ₹ 4,500 - 7,000 amended to ₹ 5,500 - 9,000 is noted. The said office order in below the star note contains that the revised pay scale of ₹ 5,500 - 9,000 is subject to approval of Government of India. Respondents were handicapped as the revised pay scale of ₹ 5,500 - 9,000 did not get the approval of Department of Expenditure, Government of India. Tribunal agreed to the situation faced by Institute of NIPCCD as it is fully funded Institute. The matter of grant of pay scales, adoption of pay scales consequent to the revision by Central Pay Commission is subject to the approval of Government of India which is necessary to come from Ministry of Finance, Department of Expenditure through the Ministry of Women and Child Development, Administrative Ministry of the Institute.
