Applicants in this OA are 24 in number, first 16 Applicants working in All India Radio and the rest with Doordarshan. They pray for granting benefits of HRA at 'B' class rate with arrears granted to similarly situated employees, who had already obtained the relief. Tribunal at the admission stage itself directed the Respondents to compare the case of the Applicants with petitioners in O.A. No. 282 of 2013 and if they are similarly situated similar benefit of granting HRA at rates admissible to ‘B' class cities shall be granted to the Applicants herein also — O.A. 044/00146 of 2019 is a case involving 24 applicants who work in All India Radio and Doordarshan, seeking benefits of HRA at 'B' class city rate with arrears. The tribunal directed the respondent... — Facts:There are 24 Applicants in this OA. They are similarly situated and pray for same relief. Hence all the cases are disposed of at the admission stage itself. First 15 Applicants are working in the office of Director Engineering, All India Radio, Aizawl and the rest are working in Doordarshan Kendra, Aizawl. Prayer of the Applicant is for granting the benefit of HRA at 'B' class city rate with arrear monetary benefits from the date of actual posting of the individual Applicant at Aizawl in the light of the Judgment No. 381 of 2000 in the case of similarly situated employees of All India Radio with immediate effect. All Applicants, are working in Group 'C' and 'D' cadre. Referring to letter, dated 28-1-2019 (A/1), Applicants stated that they are denied grant of 16% of HRA - 'B' class cities only on the ground that they are not Applicants in O.A. No. 381 of 2000 (CP No. 584 of 2014) in High Court, dated 25-4-2003. Applicants state that they are denied 16% HRA as others as they did not approach the Tribunal. It is further stated that the case of the Applicants are squarely covered by the direction in O.A. No. 381 of 2000 of the Tribunal.
