Secretary, Ministry of Defence and others, where it was held that the government should consider an employee's request for po... — Facts :Applicant, a Storekeeper III working CSD Depot at Dimapur in the State of Nagaland was transferred in the last leg of his service as he has only less than 2 years left for retirement to Ramgarh from Dimapur of Jharkhand District. Against that order, this OA is filed praying for posting him in Kolkata. Tribunal stayed that transfer order and primarily observed that this OA is not a bar to accept the request of the Applicant in view of the fact that Respondents have accepted the merits in the representation of the Applicant. Applicant having completed his tenure of posting at Dimapur prays for posting at Kolkata where his wife is also serving instead of posting him at Ramgarh at the fag end of his service. Applicant relies on the OM, dated 14-12-1983 for his request. Respondents, even through deferred his transfer up to 31-1-2017 did not accept his request for posting him at Kolkata. Tribunal heard both sides. Respondents repose their order on administrative exigency. Disputing the claim of the Applicant that Kolkata is his hometown, the Respondents state that Applicant is a native of Dimapur. The fact remains that the Applicant prays for posting at Kolkata as his wife is serving in Kolkata. In the case of Narayan Choudry v. State of Tripura and others reported in [ 2000 (1) GR 519 ], it was held that retiring employee may be posted in the place of his choice.
