Being aggrieved with the said impugned Transfer Order, he has made one representation, dated 15-6-2023 before the Commissioner of Customs (Preventive), North-Eastern Region, Shillong, Meghalaya, which is still pending.

During the course of hearing, Learned counsel for the Applicant has fairly submitted that it would suffice the purpose of the Applicant if the Respondent No. 3 i.e. the Commissioner of Customs (Preventive), North-Eastern Region, Shillong, Meghalaya will be directed to consider the pending representation of the Applicant, dated 15-6-2023 treating this OA as part of it within a short period of time. Learned Senior CGSC for the Respondents has submitted that the Applicant has been transferred within 3 km peripheral area. However, he has no objection if a direction be issued to the Respondents to consider the representation of the Applicant.
