Rotational transfer to be considered keeping in with the date of superannuation within two years — This chunk pertains to an Original Application (OA) No. 043/00242 filed by a Customs Division employee who was transferred from Shillong to Karimganj in July 2022, despite not having had the opportun... — Facts: The instant OA has been filed by the Applicant assailing the impugned Transfer Order, dated 19-7-2022 whereby he has been transferred from Customs Division, Shillong to Customs Division, Karimganj. According to the Applicant, three choice posting preferences are normally given with regard to Annual Transfer Drive, 2021. However, without considering the same, he has been transferred to Customs Division, Karimganj. Presently, since the Applicant is having less than 2 years of service, he could not submit any choice of posting during the Annual Transfer Drive, 2022. Thus, he made a representation, dated 2-9-2022 before the Commissioner, Customs(P), NER, Shillong for reconsideration of his transfer on the sympathetic ground. Counsel for the Respondent has not objected to the same.

Request was made on behalf of the Applicant that it would suffice if the OA would be disposed of by directing the Respondent authorities to reconsider Applicant's representation with regard to Annual Transfer Drive, 2022 and communicate their decision within a short span of time since he is left with only 1 year and 10 months of service for retirement and his wife is also suffering from serious illness.
