Director-General, NIC formulated a Transfer Policy which was approved by the Director-General, NIC, R-2 herein. Application was invited from employees for transfer from hard / remote locations and those at hard places to other locations of their choice. Priority was given for transfer of employees who have completed ‘a to e' locations as noted in the judgment.

As a follow-up of Circular, dated 19-3-2014, the Respondent-Authority issued a new transfer / posting to hard areas / remote locations. Tripura is in hard area / remote location lists. Posting in the hard areas is for two years. It is stated that the father of the Applicant, aged 64 years suffering from paralysis needed medical check-up for which care of his son is required. In view of the policy, the Applicant who is in hard location requested for transfer as per NIC policy for transfer to West Bengal where his spouse is posted. But his request was not considered.
