T... — Facts: Applicant was a Junior Secretarial Assistant (JSA), (earlier designated as LDC) Jawahar Navodaya Vidyalaya (JNV), Arunachal Pradesh. As per the transfer policy of Navodaya Vidyalaya Samiti, it envisages that on completion of mandatory tenure at N.E. Region/Hard and Difficult stations, employees will be given posting of their choice of stations on their request. As per policy, the normal tenure for LDC in a particular station is 10 years. That tenure is further categorized for less number of years in very hard and difficult stations. Those in hard stations will be given posting of their choice based on available vacancy. Non-teaching employees working in those hard stations has to give online application for posting in their choice station to the principal of the respective school. Applicant working in hard station at Arunachal Pradesh for 11 years submitted application, dated 30-8-2019 in prescribed format giving choice at JNV, Nalbari, deemed vacancy, JNV Barpeta, actual vacancy and at the station against protected vacancy. But the Respondent authorities rejected the case of the Applicant and ordered choice posting for two other employees. Having browbeaten by the reported arbitrary action of Respondents, Applicant had given a representation which was not considered.
