What This Means

Para 5.5.6 of the Manual for Procurement of Consultancy Services deals with how bidders can change or withdraw their bids. Think of it like submitting an application – you can revise it as many times as you want before the deadline. You can completely replace your old bid with a new one, or just make changes. The important thing is that the system will only consider the very last bid you submitted before the deadline.

However, once the deadline passes, you're locked in. You can't change your bid, and you can't withdraw it without facing consequences. If you try to back out or alter your bid after the deadline but before the bid's validity period expires, you'll lose your bid security (EMD) and might face other penalties. This rule ensures fairness and prevents bidders from manipulating the process after seeing other bids.

  • The last bid submitted before the deadline is considered the valid bid.
  • Bidders can withdraw their bid before the submission deadline without penalty.

Practical Example

M/s. Innovative Solutions initially submitted a bid of ₹50 lakhs for a consultancy project on January 15th, with a bid submission deadline of January 31st. On January 25th, after reviewing their cost estimates, they realized they had underestimated certain expenses. They revised their bid, increasing it to ₹55 lakhs, and uploaded the revised bid before the January 31st deadline. The system will consider only the ₹55 lakhs bid. However, if Innovative Solutions tried to withdraw their bid on February 5th (after the deadline), their EMD of ₹2.5 lakhs would be forfeited, and they might face further penalties. In another scenario, if M/s. Creative Designs submitted a bid but withdrew it on January 28th, before the deadline, their bid would not be considered, and they would not face any penalties.
