Can the appellate authority accept fresh evidence that was not before the disciplinary authority?

Generally, the appeal is decided on the record before the disciplinary authority. However, the appellate authority may remit the case for further inquiry if there is some error that warrants it. Fresh evidence submitted directly to the appellate authority is usually not considered unless there are compelling exceptional circumstances.
